Terms and Conditions

Last updated: September 23, 2026

These Terms and Conditions govern access to and use of the BAS Part Sales website and purchases from BAS Part Sales, LLC (“BAS,” “we,” “our,” or “us”). By accessing our website, creating an account, requesting a quote, making an offer, or purchasing a product, you agree to these Terms and our Privacy Policy.

BAS sells aircraft parts intended for installation and evaluation by qualified aviation professionals. You may not use this website or purchase products if prohibited by applicable law.

Our online store is hosted by Shopify. Shopify processes information when you visit or purchase from our store and may use information from your interactions with our store, other merchants, and Shopify to provide enhanced services. Information may be shared with Shopify and providers in other countries. Our Privacy Policy explains these practices and your choices.

1. Acceptance of Terms

By accessing this website, creating an account, placing an order, requesting a quote, or purchasing any product from BAS Part Sales, LLC (“BAS,” “we,” “our,” or “us”), you agree to be bound by these Terms and Conditions.

If you do not agree, you may not use this website or purchase products from BAS.

2. Nature of Products Sold

BAS is an aircraft salvage and parts supplier. Products sold may include:

  • Used parts
  • As-removed parts
  • Overhauled or repaired parts
  • Core units
  • Components removed from disassembled aircraft
  • New surplus inventory

All products are sold subject to the condition description, trace documentation, and certifications specifically stated at the time of sale.

Unless explicitly stated in writing, products are not represented as new, factory-new, or zero-time. Core Exchange requirements are described in Section 6 and in the applicable product listing or invoice.

3. Product Condition and Descriptions

BAS makes commercially reasonable efforts to ensure listings are accurate. However:

  • Photos are representative of the actual item unless otherwise stated.
  • Cosmetic condition does not imply airworthiness.
  • Listings may contain errors, omissions, or typographical mistakes.

In the event of an obvious pricing, shipping, or listing error, BAS reserves the right to cancel the order prior to shipment and issue a refund.

4. Public Pricing and Availability

All available-for-sale inventory is publicly priced on our website. Pricing is subject to change at any time prior to order confirmation. Inventory availability is not guaranteed until payment is received and the order is confirmed. Items shown in disassembly announcements, marketing posts, or early-stage processing may not yet be priced or available for purchase.

5. 90-Day Money-Back Guarantee

BAS offers a 90-day money-back guarantee on eligible products. Products identified as Core or No Returns, and fuselages, are excluded unless BAS expressly states otherwise in writing. Core Exchange Units are addressed in Section 6.

For an eligible part, the guarantee is limited to:

  • Return of the part in the same condition as delivered
  • Refund of the purchase price

The guarantee does not cover:

  • Installation labor
  • Removal labor
  • Troubleshooting time
  • Shipping costs
  • Regulatory findings
  • Buyer error in diagnosis
  • Damage occurring after delivery

Returned items must not have been altered, disassembled, or modified unless authorized in writing.

6. Core Exchange Units

Core Exchange Units are subject to BAS’s standard 90-day money-back guarantee in effect at the time of sale. Certain Core Exchange Units may carry a separate warranty issued by the overhaul facility or repair station that performed the work. Any such warranty is provided solely by the issuing facility and is not a warranty of BAS. BAS makes no independent representation or warranty beyond its 90-day money-back guarantee.

Core returns must:

  • Be the correct part number
  • Be complete
  • Be returned within the timeframe stated on the invoice
  • Not be damaged beyond normal core condition

Failure to meet core return requirements may result in forfeiture of core credit.

7. Airworthiness and Installation Responsibility

The installing mechanic, repair station, aircraft owner, and operator are solely responsible for determining:

  • Airworthiness
  • Regulatory compliance
  • Compatibility
  • Proper installation
  • Inspection
  • Continued operational suitability
  • Safe operation

BAS does not provide installation services, maintenance services, engineering approvals, or airworthiness determinations.

8. Limitation of Liability

BAS assumes no responsibility or liability for:

  • Installation errors
  • Improper maintenance
  • Regulatory non-compliance
  • Improper storage or handling after sale
  • Aircraft operation
  • Pilot judgment or decision making
  • Subsequent modification or alteration of the part
  • Acts or omissions of third parties

To the fullest extent permitted by law, BAS shall not be liable for any indirect, incidental, special, consequential, punitive, or third-party damages, including but not limited to:

  • Loss of use
  • Loss of revenue
  • Aircraft damage
  • Personal injury
  • Death

If liability is established, BAS’s total liability shall be strictly limited to the purchase price paid for the specific part at issue.

9. Shipping and Risk of Loss

All shipments are FOB shipping point unless otherwise stated in writing. Risk of loss transfers to the buyer upon delivery to the carrier. Shipping timelines are estimates only and are not guaranteed.

Buyers are responsible for:

  • Providing accurate shipping information
  • Customs clearance
  • Import duties and taxes
  • Compliance with export regulations

10. Export Compliance

Certain products may be subject to U.S. export control laws. The buyer is responsible for ensuring compliance with all applicable export regulations. BAS reserves the right to refuse any transaction that may violate export laws or sanctions programs.

11. Payment Terms

Orders must be paid in full prior to shipment unless credit terms are approved in writing.

BAS reserves the right to:

  • Cancel unpaid orders
  • Refuse future transactions
  • Require wire transfer for international orders

Chargebacks initiated without contacting BAS for resolution may result in account suspension.

12. Returns Procedure

BAS maintains a 90-day money-back guarantee on eligible items as described above. Customers are encouraged to complete the return form available on our website prior to shipping a return. Advance notice allows us to process the return efficiently, but prior authorization is not strictly required. Returned items will be inspected upon receipt. Acceptance of a returned shipment does not guarantee eligibility for refund.

Refunds may be denied if:

  • The item is not eligible under the 90-day guarantee
  • The item has been altered, disassembled, or modified
  • The item is damaged due to improper installation, handling, or storage
  • The returned item is not the original unit sold

When a refund is approved, it applies only to the purchase price of the specific part. Shipping and other associated costs are not refundable unless BAS determines that the return resulted from its own error.

The 90-day money-back guarantee described here constitutes the buyer’s sole and exclusive remedy, to the extent permitted by law.

13. No Professional Advice

Information provided by BAS, including verbal statements, emails, website descriptions, or technical discussions, is informational only. Such information does not constitute engineering advice, maintenance instruction, or regulatory approval.

14. Intellectual Property

All website content, including images, descriptions, branding, and media, is the property of BAS and may not be copied or reproduced without written permission.

15. Governing Law and Venue

These Terms are governed by the laws of the State of Colorado. Except for disputes subject to arbitration under Section 17, any court proceeding permitted by these Terms shall be brought in the state or federal courts located in Colorado.

16. Modifications to Terms

BAS reserves the right to update these Terms at any time. Updated Terms become effective upon posting.

17. Arbitration and Class Action Waiver

Any dispute, claim, or controversy arising out of or relating to the purchase of products from BAS or these Terms shall be resolved by binding arbitration administered by a nationally recognized arbitration organization. Arbitration shall take place in Weld County, Colorado, unless the parties agree otherwise, and shall be conducted by a single arbitrator. The parties waive the right to a trial by jury. The parties further agree that any dispute shall be brought solely in an individual capacity and not as part of a class, consolidated, or representative action. Class actions and class arbitrations are expressly waived. Nothing in this section prevents BAS from seeking injunctive relief in a court of competent jurisdiction to protect its intellectual property or enforce payment obligations.

18. Force Majeure

BAS shall not be liable for any delay or failure to perform resulting from causes beyond its reasonable control, including but not limited to:

  • Acts of God
  • Natural disasters
  • Fire or flood
  • Labor disputes
  • Supply chain disruptions
  • Carrier delays
  • Government actions
  • Export restrictions
  • War or civil unrest
  • Cybersecurity incidents

In such events, BAS’s obligations shall be suspended for the duration of the force majeure condition.

19. Indemnification

The buyer agrees to indemnify, defend, and hold harmless BAS, its officers, employees, affiliates, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

  • Improper installation
  • Misuse of the product
  • Failure to determine airworthiness
  • Regulatory non-compliance
  • Unauthorized modification or alteration
  • Operation of an aircraft incorporating the part
  • Personal injury, death, or property damage resulting from the buyer’s actions or omissions

This indemnification obligation survives the sale of the product.

20. Right to Refuse Service

BAS reserves the right to refuse service, cancel orders, limit quantities, terminate accounts, or decline transactions at its sole discretion, including but not limited to situations involving:

  • Suspected fraud
  • Pricing errors
  • Abusive conduct
  • Export compliance concerns
  • Repeated abusive return activity
  • Chargeback abuse

21. Fraud Screening

BAS uses third-party fraud detection services, including NoFraud when used, to evaluate certain transactions. Order information needed to process payment and verify transactions may be shared with payment processors and fraud prevention providers. Orders flagged for review may be delayed, canceled, or require additional verification.
